Vybe is a global communications app — a second phone number, end-to-end encrypted chat, and HD calling in 50+ countries — operated by an Indian company. These Terms are written in plain English but are a binding legal contract. Where local law (in your country) gives you extra rights, those rights are preserved.
1. Who we are
Vybe is operated by Megmaa Solutions Pvt. Ltd.(“Megmaa”, “we”, “us”, “our”), a private limited company incorporated under the Companies Act 2013, India.

“You” means the individual or organisation that creates a Vybe account.
2. Definitions
- Service / Vybe — the Vybe mobile and web app, our APIs, and any related Megmaa-operated infrastructure.
- Account — your authenticated profile, identified by an email address.
- Vybe Number — a phone number provisioned to you via Vybe (Indian or foreign), routed through us or our upstream carrier.
- Content — anything you send, receive, store or generate using Vybe (messages, voicemails, recordings, call logs, contacts you upload).
- Subscription — a recurring paid plan that activates a Vybe Number and its features.
- Top-up — a one-time purchase of in-app credits (“Vybe Coins”) used for over-plan minutes or international calls.
3. What Vybe is (and isn't)
Vybe provides communications services. We are an “intermediary” under §2(1)(w) of India's Information Technology Act 2000 — we carry your messages and calls but do not generate or moderate them. We rely on third-party carriers for telecom interconnection.
Vybe is not a substitute for traditional telephony.Calls require internet connectivity. Quality depends on your network, device, and our upstream providers.
4. Eligibility & age
You must meet the minimum age in your country:
- India: 18 years (legal capacity to contract under §11 of the Indian Contract Act 1872).
- European Union / United Kingdom: 16 years (or the minimum digital-consent age set by your country, where lower).
- United States: 13 years (in compliance with COPPA). Users under 18 must have parental consent for paid features.
- Elsewhere: 13 years, or the minimum digital-consent age set by your local law — whichever is higher.
Paid subscriptions are only available to users with full legal capacity to contract in their country (typically 18+). By accepting these Terms you confirm you meet these requirements and that you have not been previously banned from Vybe.
5. Your account
You are responsible for keeping your password and devices secure. Enable two-factor authentication if available. Notify us immediately of any unauthorised access at security@vybe.app.
You may not share your account, sell it, or use it on behalf of another person or business not associated with you. One Vybe account is for one human.
6. Suspension & termination
You may delete your account at any time from Settings → Profile → Delete account. After 30 days your personal data is irreversibly purged from our active systems (some anonymised logs and legally-required billing records are retained per our Privacy Policy).
We may suspend or terminate your account if you breach these Terms, if your activity puts our service or other users at risk, or if we are required to do so by law or by an upstream carrier. We will give you at least 30 days' notice except for serious breaches (fraud, illegal use, security risk, repeated abuse, or court order).
7. Acceptable use
You agree NOT to use Vybe to:
- Send spam, scams, unsolicited commercial communications, or any communication that violates TRAI's Telecom Commercial Communications Customer Preference Regulations (or equivalent rules in other countries).
- Impersonate any person, entity, or government agency.
- Harass, abuse, stalk, defraud, threaten, or otherwise harm anyone.
- Distribute malware, phishing links, child sexual abuse material, terrorist content, or other illegal material.
- Make prank calls, swatting calls, false emergency reports, or hoax communications.
- Bypass our rate limits, scrape our service, or attempt to reverse-engineer or decompile our software.
- Resell Vybe Numbers, share them as a service to third parties, or use them for bulk telemarketing without an explicit written agreement with us.
- Violate any applicable law (including India's IT Act, Indian Penal Code, Telegraph Act 1885; or equivalent laws in your country).
We may report serious violations to Indian or foreign law-enforcement authorities. Suspension or termination for breach of this section is without refund.
8. Vybe Numbers
Vybe Numbers are provisioned to you for use — they are not sold or assigned to you. They remain the property of Megmaa and our upstream carriers. When your subscription ends or you delete your account, the number returns to the pool and may be re-issued to another user after a grace period (currently 30 days; subject to carrier rules).
Different countries require different identity / KYC steps. Numbers in India and several other jurisdictions are subject to regulatory-bundle approval (proof of identity and address). You agree to provide accurate KYC information when requested. Inaccurate or fraudulent KYC may result in number revocation and account suspension. We do not refund subscriptions where the loss of service is caused by failed or revoked KYC.
9. Call recording
India follows a one-party consent rule for call recording (a participant in the call may record without the other's express consent). Many other countries — including most of the EU, the UK, Canada, Australia, and certain US states — require all-party consent. If Vybe's recording feature is available to you, it is your responsibility to obtain consent from all participants where local law requires it. Megmaa is not liable for your non-compliance with applicable recording laws.
10. Emergency services
Vybe is not an emergency service. Calls to emergency numbers (112 in India and EU, 911 in the US, etc.) may not connect or may not route to the correct local emergency responder. Always use your underlying carrier's native dialer for emergencies, and keep your physical SIM active.
11. Subscriptions & auto-renewal
- Subscriptions are billed in advance for each cycle (monthly or annual) and renew automatically until cancelled.
- You can cancel at any time from within the app or via your platform store (Apple App Store, Google Play). Cancellation takes effect at the end of the current paid cycle — your number stays active until then.
- You may hold up to three (3) active Vybe Numbers under one account.
- We may change prices with at least 30 days' notice. Existing subscribers keep their current price for the remainder of the active cycle.
12. Taxes
All subscription and top-up prices in India are inclusive of applicable Goods and Services Tax (GST) unless otherwise indicated. For users outside India, your platform store (Apple / Google) calculates and remits any local VAT, sales tax or similar consumption tax according to your billing country.
You are responsible for any other taxes (including withholding tax, where applicable) imposed on you by your local authority.
13. Refunds
Refunds are generally processed by the platform store you purchased through (Apple App Store or Google Play Store) under their respective refund policies. We do not directly process refunds for store-mediated purchases.
Nothing in these Terms limits your statutory consumer rights — including, for Indian users, rights under the Consumer Protection Act 2019 and the Consumer Protection (E-Commerce) Rules 2020; for EU/UK users, rights under your local consumer-protection law. If a non-waivable consumer right applies to you, that right prevails over anything in this section.
Top-up coin packs and add-on credits are non-refundable once delivered to your account, subject to the rights above.
14. Service availability
We target 99.9% monthly uptime but do not guarantee uninterrupted service. Calls depend on your network, your device, carrier interconnection, and third-party providers. We may need to take scheduled maintenance windows; we'll notify you in advance for any window expected to exceed 30 minutes.
15. Privacy & data protection
Your use of Vybe is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains our compliance with:
- India's Digital Personal Data Protection Act 2023 (DPDP Act) and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011.
- EU & UK General Data Protection Regulation (GDPR / UK GDPR) for users in those territories.
- California Consumer Privacy Act (CCPA / CPRA) for California residents.
- Equivalent data-protection laws in other countries where we offer service.
Chat between Vybe users is end-to-end encryptedusing Signal-grade Olm/Megolm — we cannot read its content even if compelled. SMS, voice calls and metadata flow through our carriers and are subject to lawful-intercept obligations under applicable laws.
16. Your content & licence to us
You own everything you send through Vybe (messages, voicemails, recordings, files). By using the service you grant Megmaa a worldwide, non-exclusive, royalty-free licence to process, store, transmit and back up your Content solely to provide the service — for example, delivering an SMS, transcribing a voicemail, or holding a copy until you read it. This licence ends when you delete the Content or your account.
17. Our intellectual property
The Vybe brand, the Vybe diamond mark, our software, designs, copy and documentation are the property of Megmaa Solutions Pvt. Ltd., protected by Indian copyright and trademark law and equivalent laws in other jurisdictions. You may not copy, modify, reverse-engineer or use our trademarks without our prior written consent.
18. Third-party services
Vybe integrates with third-party service providers across categories including telecom interconnection, push notifications, crash reporting, product analytics, platform payments and cloud infrastructure. Use of those services is governed by their respective terms and privacy policies, and we are not responsible for their acts or omissions beyond exercising reasonable care in selecting them. The categories of providers we rely on, and how to obtain the current named list, are described in §5 of our Privacy Policy.
19. Force majeure
Neither party is liable for failure or delay caused by events beyond reasonable control — including but not limited to acts of God, war, terrorism, civil disturbance, government action, pandemic, internet/carrier outages, undersea cable cuts, denial of service attacks, or natural disasters. Our obligations are suspended for the duration of the force majeure event.
20. Warranties & disclaimers
Vybe is provided “as is” and “as available”. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied — including merchantability, fitness for a particular purpose, non-infringement, accuracy and uninterrupted availability. Where local law gives you mandatory warranties that cannot be waived, those warranties continue to apply.
21. Limitation of liability
To the maximum extent permitted by applicable law, Megmaa's total aggregate liability for any claim arising out of or relating to these Terms or your use of Vybe is limited to the greater of (a) the amounts you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) ₹10,000 / US $150.
We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages — including loss of profit, loss of business, loss of data, or loss of goodwill — even if we have been advised of the possibility of such damages.
Consumer-rights carve-out. Nothing in this section limits liability for (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) gross negligence or wilful misconduct; or (iv) any liability that cannot legally be excluded under your local consumer-protection law.
22. Indemnity
You agree to indemnify and hold harmless Megmaa, its directors, officers, employees and agents from and against any claim, liability, damage, loss or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any applicable law, or your misuse of the service.
23. Grievance redressal (India — IT Rules 2021)
In accordance with Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, the details of our Grievance Officer are:

We will acknowledge complaints within 24 hoursand resolve them within 15 days of receipt, as required by the Rules. For complaints about content that violates these Terms, please include the URL or message details, and the nature of the violation.
24. Governing law & dispute resolution
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles.
Arbitration. Any dispute, controversy or claim arising out of or relating to these Terms or your use of Vybe — including its existence, validity, interpretation, breach or termination — shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act 1996 (India). The seat and venue of arbitration shall be Bangalore, Karnataka, India. The arbitration shall be conducted in English by a sole arbitrator appointed by mutual agreement, or failing that, in accordance with the Act. The arbitrator's award shall be final and binding.
Court jurisdiction. Subject to the arbitration clause above, the courts of Bangalore, Karnataka, India shall have exclusive jurisdiction.
Consumer carve-outs.
- EU / UK consumers retain all mandatory rights under their local consumer law and may bring proceedings in the courts of their country of residence.
- Indian consumers retain all rights under the Consumer Protection Act 2019, including the right to approach a District / State / National Consumer Disputes Redressal Commission of competent jurisdiction.
- Nothing in this clause limits your right to seek injunctive or other equitable relief in any competent court to protect intellectual-property or confidential information.
25. Changes to these Terms
We may update these Terms from time to time. For material changes we will notify you at least 30 days in advance by email and via in-app notice. Continued use of Vybe after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may delete your account before the effective date.
26. Severability & entire agreement
If any provision of these Terms is held by a court of competent jurisdiction to be unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remainder of these Terms shall remain in full force and effect.
These Terms (together with our Privacy Policy and any in-product agreements) constitute the entire agreement between you and Megmaa regarding Vybe, and supersede any prior understandings or communications.
